Comprehensive consumer law assistance
Our firm focuses primarily on four areas of consumer law in which consumers frequently require legal assistance. We can assist you with the following consumer law matters:
- Lemon law: A new automobile — no more than one year old and still under warranty — is a lemon if it has a serious defect the dealer is unable to fix in four attempts, or it has one or many defects that prevent you from using it for 30 days or more. Keep in mind that the 30 days out-of-service do not need to be consecutive. The defect must seriously affect the use, value or safety of your car and must be covered by the warranty. There are important steps that the consumer must take to provide notice to the manufacturer prior to initiating a lemon law action.
- Auto Fraud: Even if the vehicle you purchase isn’t new, you are still protected by the law from deceptive and misleading sales practices. Individuals purchasing used cars buy them “as-is”. However, that does not give the dealer the right to misrepresent the condition of the vehicle or provide any other false information regarding the car to get you to purchase it. Wisconsin law (Wis. Stat. § 100.18) protects consumers from deceptive sales practices. We handle claims involving false advertising, warranty disputes and other issues, as well.
- Home improvement disputes: Under Chapter 110 of the ATCP (Administrative Trade Consumer Protection), homeowners are protected from deceptive and misleading home improvement practices. ATCP 110 covers virtually every type of home improvement, including: landscaping, roofing, siding and driveways. Homeowners may be entitled to double damages and attorney’s fees if their claim is successful.
- Creditor harassment: Third-party debt collection is governed by the Fair Debt Collection Practice Act. You may be entitled to damages if certain notice requirements and procedures are not followed by a company attempting to collect a debt from you. Hiring an attorney will also stop harassing debt collection phone calls. If debt-collectors are harassing you, we can help.
